HUD Proposes Citizenship Verification Requirement for Federally Assisted Housing

The U.S. Department of Housing and Urban Development (HUD) has announced a proposed rule that would require proof of U.S. citizenship or eligible immigration status for all residents of HUD-funded housing. If finalized, the rule would apply to mixed-status households and would prohibit housing assistance from benefiting individuals without verified eligibility. The department stated that the proposal follows an agency audit identifying tens of thousands of tenants with incomplete or unclear documentation and estimates that a portion of assisted households may include ineligible residents.

HUD Secretary Scott Turner said, “HUD’s proposed rule will guarantee that all residents in HUD-funded housing are eligible tenants. We have zero tolerance for pushing aside hardworking U.S. citizens while enabling others to exploit decades-old loopholes.”

The department noted that the rule builds on prior coordination with the Department of Homeland Security (DHS) and recent reviews of tenant documentation.
