It is the first trial to treat Antifa as a terrorist organization.
District Judge Mark Pittman declared a mistrial in the first case against members of Antifa as a terrorist organization. An attorney for the defense of the 9 members of Antifa implicated in the 2025 shooting ambush of a police officer at a Texas U.S. Immigration and Customs Enforcement (ICE) detention center wore a tee shirt with the images of civil rights icons under her blazer during the jury selection.
“I don’t know why in the world you would think that’s appropriate,” Judge Pittman stated. “This has to be a first in the history of American jurisprudence, I would think. I’m left with no other choice.”
Judge Pittman had previously rejected a motion to exclude a large portion of evidence from the trial. One of the attorneys for the defense had requested the exclusion “all physical evidence including, but not limited to, firearms, ammunition, printing devices, laptops, notes, cell phones, pamphlets, knives, identification, documentation, radios, tablets, [and] storage devices”, including statements from the defendants at that time.
