HHS and DEA Extend Telemedicine Prescribing Flexibilities Through 2026

Temporary extension maintains access to certain controlled medications.

The Department of Health and Human Services (HHS), in coordination with the Drug Enforcement Administration (DEA), announced a fourth temporary extension of telemedicine rules allowing certain controlled medications to be prescribed without an initial in-person visit. The extension runs from January 1 through December 31, 2026, to prevent disruptions in care while federal agencies finalize permanent regulations governing telehealth prescribing.

“Telehealth prescribing flexibilities have become a lifeline for millions of Americans,” said Deputy Secretary Jim O’Neill. “Extending them ensures continuity of care while we finish the work of putting permanent, commonsense policies in place. This action protects patients, preserves access, and maintains strong controls against diversion.”

Federal officials cited data showing continued reliance on telemedicine for treatment, including mental health and substance use care. The extension preserves existing safeguards, including requirements that prescriptions be issued by licensed practitioners for legitimate medical purposes and in compliance with federal and state law.
