The appellate panel determined that the nation’s capital holds a unique status, since the district was created by Congress.
A panel of the District of Columbia U.S. Circuit Court of Appeals upheld President Donald Trump’s authority to deploy the National Guard in Washington, D.C.
Judge Patricia Millett wrote, “Because the District of Columbia is a federal district created by Congress, rather than a constitutionally sovereign entity like the 50 states, the defendants appear on this early record likely to prevail on the merits of their argument that the president possesses a unique power within the District — the seat of the federal government — to mobilize the Guard.”
The decision overturns a lower court ruling and allows the National Guard to remain stationed in the nation’s capital as the court case proceeds.
As the Lord Leads, Pray with Us…
- For President Trump and officials in his administration as they seek to improve public safety and support law enforcement.
- For judges in district and appellate courts to be discerning in their interpretations of the Constitution and federal laws.
