State Department Issues New Guidance on Inadmissible Health Conditions for Visas

Chronic health issues such as obesity, diabetes, and other diseases will be considered under the public charge risk.

The State Department released new guidance on the health conditions that would be inadmissible under the restriction for visas for foreigners who could become a public charge. The expanded conditions include diabetes, obesity, cardiovascular disease, respiratory disease, and neurological or mental-health disorders.

The department guidance questions whether the applicant has “adequate financial resources to cover the costs of such care over his entire expected lifespan without seeking public cash assistance or long-term institutionalization at government expense?”

The guidance applies to immigrant visas, family- or employment-based applicants, applicants with dependents, and the applicants’ financial or insurance resources.
