Federal Judge Allows DOJ to Proceed with Assault Case Against Congresswoman

Representative McIver had motioned for a dismissal of the case, claiming she was politically targeted.

U.S. District Judge Jamel Semper ruled that the Department of Justice may continue its case against Representative Lamonica McIver. The congresswoman had attempted to get her case thrown out after she was arrested and charged with assault for “forcible impeding and interfering with federal officers” during her visit to a U.S. Immigration and Customs Enforcement (ICE) facility in New Jersey earlier this year.

Congresswoman McIver claimed that her actions were “part of her lawful oversight duties as a member of Congress” and “her actions were covered by the Constitution’s protection against arrest or prosecution while engaged in legislative business.”

The judge said Representative McIver could not claim legislative immunity for all her actions, though he found one of the charges against her to be covered under Congress’ “Speech and Debate” privilege. Judge Semper said that the congresswoman failed to show that the prosecution by President Trump’s administration is “vindictive.”
