Education Department Updates Student Loan Forgiveness Program Rule

The change blocks access to the PSLF program for employers who engage in illegal or discriminatory activities.

President Donald Trump’s administration released a new rule for the Public Servant Loan Forgiveness (PSLF) program that aligns with the immigration enforcement agenda. The program forgives student debt for government and nonprofit workers after 10 years of qualifying payments.

The new rule narrows the definition of “public service” and prohibits participation in the program for those engaged in discrimination or violations of immigration laws. The rule also excludes those who habitually violate state laws.

The Department of Education redefined qualifying employers “to exclude employers that participate in illegal activities such that they have a substantial illegal purpose.”

“Taxpayer funds should never directly or indirectly subsidize illegal activity,” Under Secretary of Education Nicholas Kent stated. “With this new rule, the Trump Administration is refocusing the PSLF program to ensure federal benefits go to our Nation’s teachers, first responders, and civil servants who tirelessly serve their communities.”
