7th Circuit Halts Order for Border Chief to Daily Appear in Court

A district judge had issued detailed orders for Border Patrol officials in Operation Midway Blitz.

The Seventh Circuit U.S. Court of Appeals stayed District Judge Sarah Ellis’ order that Border Patrol Commander Gregory Bovino appear before her court every day at 5:45 pm until November 5. Judge Ellis ordered that the chief must daily report on ongoing immigration enforcement actions and compliance with her orders regarding the use of tear gas, excessive force, and the wearing of body cameras.

The Department of Justice (DOJ) filed an emergency motion with the appellate court the day after Judge Ellis’ order, stating that it “significantly interferes with the quintessentially executive function of ensuring the Nation’s immigration laws are properly enforced by waylaying a senior executive official critical to that mission on a daily basis.”

“Absent a stay, the government will be irreparably harmed because Chief Bovino will be required to prepare and sit for questioning in open court today and every weekday thereafter, with no stated endpoint in sight,” the DOJ’s motion stated. “Every occasion that Chief Bovino is required to prepare and appear for those daily court sessions is time that he would otherwise spend carrying out the important law-enforcement functions he has been assigned.“

Judge Ellis has scheduled a full preliminary hearing for November 5.
