The Justice Department filing states that the injunction by the lower court “improperly impinges on the president’s authority.“
President Donald Trump’s administration requested that the Supreme Court allow National Guard troops to be deployed to Chicago, Illinois, on Friday, after a lower court ruled to block the deployment.
The Department of Justice filed an emergency request for the high court to block the district judge’s halt of hundreds of troops to protect federal property from anti-ICE demonstrators and provide support to law enforcement.
“This Court should stay the district court’s October 9 injunction in its entirety,” Solicitor General John Sauer wrote in the administration’s request to the justices. “The injunction improperly impinges on the President’s authority and needlessly endangers federal personnel and property.”
The president has also deployed National Guard to Memphis, Tennessee, and Portland, Oregon, though the latter has also received a judicial block.
