Multiple jurisdictions seek to block the National Guard as demonstrations continue near ICE facilities.
The Seventh Circuit U.S. Court of Appeals upheld District Judge April Perry’s restraining order temporarily barring the deployment of the National Guard to Illinois. President Trump had ordered the deployment of the National Guard to “protect U.S. Immigration and Customs Enforcement and other U.S. Government personnel who are performing federal functions, including the enforcement of federal law, and to protect federal property.”
Judge Perry had declined to immediately block the deployment, but later issued the order to halt it for two weeks. The appellate court did issue a partial stay of Judge Perry’s order, ruling that the National Guard would remain under federal control temporarily.
“Amidst ongoing violent riots and lawlessness, that local leaders like (Illinois Gov. JB) Pritzker have refused to step in to quell, President Trump has exercised his lawful authority to protect federal officers and assets,” White House spokesperson Abigail Jackson stated in response to the ruling. “President Trump will not turn a blind eye to the lawlessness plaguing American cities and we expect to be vindicated by a higher court.”
A federal judge has also blocked the deployment of the National Guard to Portland, Oregon, while a lawsuit proceeds.
