Chief Judge David Nye

David Charles Nye was born in October 1958 in Lynwood, California. He received his undergraduate degree from Brigham Young University and Juris Doctor from Brigham Young University, J. Reuben Clark Law School. He clerked for a judge on Idaho’s Fifth District Court, then joined a law firm, specializing in medical malpractice and insurance law. Nye became a judge in Idaho’s Sixth Judicial District in 2007.
President Barack Obama nominated Nye to serve as a judge for the United States District Court for the District of Idaho in April 2016. After the nomination expired, President Trump renominated him in May 2017. He was unanimously confirmed by the Senate and received his commission in July 2017. He became chief judge in January 2019.

U.S. District Chief Judge David Nye has again upheld the Idaho law that prohibits the use of restrooms according to transgender identity. The two biological male college students previously tried to halt the state law through a request for a preliminary injunction.
Chief Judge Nye ruled, “Plaintiffs’ arguments in their present motion mirror those previously before the Court. They clearly disagree with the Court’s analysis, but they do not present any new or expanded caselaw or arguments that merit a departure from the Court’s prior reasoning or analysis.“
Judge Nye stated that Idaho was likely to prevail since the state “has an interest in protecting its citizens’ privacy and that the law mandates universities offer single occupancy restrooms as an alternative.”
The state law requires colleges, universities, prisons, and domestic violence shelters to restrict access to shared restrooms and sleeping quarters to those aligned with one’s biological sex.
The plaintiffs have appealed to the Ninth Circuit Court of Appeals.
