Federal review cites restroom conversions and district policies as noncompliant with sex-based protections.
The Department of Education’s Office for Civil Rights (OCR) determined that Denver Public Schools (the District) violated Title IX by converting sex-specific restrooms into all-gender facilities and maintaining policies that allow students to access bathrooms based on gender identity rather than biological sex.
The investigation, launched in late January, concluded these practices created unequal access for female students and raised concerns about privacy and safety. The findings stemmed from complaints following East High School’s conversion of a girls’ restroom to an all-gender facility in December 2024.
Acting Assistant Secretary for Civil Rights Craig Trainor stated, “Denver is free to endorse a self-defeating gender ideology, but it is not free to accept federal taxpayer funds and harm its students in violation of Title IX. The Trump Administration will work relentlessly to hold accountable school districts that harbor the ideological fanatics and policies that sully students’ educational experience with sex discrimination.”
