Supreme Court Declines to Block Mississippi Social Media Age Verification Law

Allows ongoing lawsuit to continue without immediate intervention

The Supreme Court declined to block a Mississippi law that imposes age verification and parental consent requirements on social media sites as the case proceeds through lower courts.

The state has been sued by NetChoice, a trade association that represents Facebook, Instagram, Reddit, X, YouTube and other sites. NetChoice filed an emergency appeal with the Supreme Court, asking it to block the Mississippi law from going into effect while its lawsuit is being processed. The Supreme Court denied the request. However, Justice Brett Kavanaugh’s concurrence indicated that the suit may succeed under the First Amendment.

A spokesperson for Mississippi Attorney General Lynn Fitch said the state is “grateful for the Court’s decision to leave Mississippi’s law in effect while the case proceeds in a way that permits thoughtful consideration of these important issues.”

As the Lord Leads, Pray with Us…

  • For the justices of the Supreme Court as they respond to requests for stays and injunctions during the remainer of their recess.
  • For wisdom for the justices as they review and prepare to hear cases in October.
