Supreme Court Takes On Challenges to Transgender Athletes in Women’s Sports

Will hear arguments for two cases challenging Idaho, West Virginia state laws.

On Thursday, the Supreme Court announced that it will hear arguments for two lawsuits filed against Idaho and West Virginia challenging their state bans on biological male athletes competing as transgender in women’s sports.

Two district courts ruled in favor of the plaintiffs challenging the laws, overturning the bans imposed by the states. Idaho and West Virginia appealed to the Supreme Court, arguing that “biological sex” was the main criterion for gendered leagues upheld by previous court decisions.

“Recognizing these common-sense ideas, courts across the country have found for decades that men and women may be constitutionally separated by biological sex when it comes to sports,” West Virginia’s petition said.
