Senate Measure Offers Backpay to U.S. Troops Discharged Over Vaccine Refusal

The act would compensate servicemembers affected by the now-repealed COVID-19 vaccination mandate.

U.S. Senator Tim Sheehy of Montana introduced the COVID-19 Military Backpay Act of 2025 last month to provide financial compensation to military personnel who were discharged due to noncompliance with the federal COVID-19 vaccine mandate. The bill addresses the loss of pay, benefits, and retirement accrual experienced by thousands of servicemembers, including approximately 60,000 from the Army Reserve and National Guard. These discharges came as a result of a mandate from President Biden’s administration which was later deemed unlawful and repealed in the 2023 National Defense Authorization Act.

“This unacceptable action by the last administration robbed servicemembers of the pay and benefits they rightfully earned in service to our country. My legislation will right this wrong by building on President Trump’s Executive Order to reinstate those servicemembers, ensuring we fulfill our government’s sacred obligations to the men and women who put their lives on the line in defense of our freedoms,” said Senator Sheehy.

The legislation would allow eligible servicemembers to opt into a claims process for backpay and other compensation under the Military Pay Act.
