Supreme Court Allows Lawsuits Against Palestine Terror Organizations

Unanimous opinion says federal law does not violate due process guarantees.

The Supreme Court unanimously upheld a 2019 federal law making it legal to sue two Palestinian organizations for damages from terror attacks. The judges of the high court ruled that the law did not violate the Constitution’s guarantees for due process because the law only applies to specific kinds of civil lawsuits filed under the Antiterrorism Act.

Chief Justice John Roberts wrote in the court’s main opinion that Antiterrorism Act cases are “a narrow category of claims that provide civil remedies only for Americans injured by acts of international terrorism.”

Chief Justice Roberts added that the law “reasonably ties the assertion of federal jurisdiction over the [Palestine Liberation Organization] and [Palestinian Authority] to conduct that involves the United States and implicates sensitive foreign policy matters within the prerogative of the political branches.”
