SCOTUS Allows Deportations of Criminal Aliens to Third-Party Nations

The administration does not have to warn criminal migrants ahead of time when their nations of origin refuse to take them.

The Supreme Court allowed President Trump’s administration to deport criminal migrants to third-party nations without advanced notice or additional processing for the time being. The deportations utilize removal to third-party nations when illegal aliens’ countries of origin will not accept them. The decision paused an order from a lower court that the administration must provide warning to illegal aliens before they are removed.

“When illegal aliens commit crimes in this country, they are typically ordered removed,” wrote Solicitor General John Sauer in his petition to the court. “But when those crimes are especially heinous, their countries of origin are often unwilling to take them back. As a result, criminal aliens are often allowed to stay in the United States for years on end, victimizing law-abiding Americans in the meantime. The Executive Branch has taken steps to resolve this problem by removing aliens to third countries that have agreed to accept them.”

Justice Sonia Sotomayor wrote a 19-page dissent for the minority that included Justices Elena Kagan and Ketanji Brown Jackson.
