Circuit Court Panel Rules President May Control National Guard

They apply the precedent that presidents have vast discretion for deploying the military to address civil unrest.

A panel of three judges on the Ninth Circuit Court of Appeals panel ruled on Thursday that President Donald Trump may maintain control of the California National Guard troops he deployed to Los Angeles to protect federal property and assist law enforcement during anti-ICE riots. All three judges said that the president’s decision to federalize the state’s National Guard was insulated from judicial review, a law to which the judges said they would remain “highly deferential.”

“Both irreparable harm and the public interest weigh in favor of Defendants, who have an uncontested interest in the protection of federal agents and property and the faithful execution of law,” the court wrote in its decision. “The undisputed facts demonstrate that before the deployment of the National Guard, protesters ‘pinned down’ several federal officers and threw ‘concrete chunks, bottles of liquid, and other objects’ at the officers. Protesters also damaged federal buildings and caused the closure of at least one federal building.”

“Affording the President that deference, we conclude that it is likely that the President lawfully exercised his statutory authority,” the court said in its 38-page ruling.

President Trump responded, “This is a Great Decision for our Country, and we will continue to protect and defend Law abiding Americans. Congratulations to the Ninth Circuit, America is proud of you tonight!”
