Federal Judge Declines to Block Firing of Three CPB Board Members

He says a preliminary injunction is not necessary, but agrees with a lawsuit brought by CPB

District Judge Randolph Moss rejected the Corporation for Public Broadcasting’s (CPB) request for a preliminary injunction to temporarily block the removal of three board members by President Donald Trump.

The corporation argued that, as an independent agency managed by Congress, President Trump had no authority to enact change within its structure. However, a plaintiff must demonstrate “irreparable harm” for a preliminary injunction to be placed to block an action before the resolution of a lawsuit, which Judge Moss ruled was not the case concerning the firings.

“For present purposes and on the present record, it is enough to conclude that Plaintiffs have failed to carry their burden of demonstrating that they are likely to prevail on the merits of their claim for injunctive relief or that Plaintiffs are likely to suffer irreparable harm in the absence of preliminary relief,” the judge wrote in his opinion.
