Appeals Court Stays Ruling Returning National Guard to State Control

The judicial panel issued a stay against the lower court ruling that said the president deployed the National Guard illegally.

A panel of the Ninth Circuit Court of Appeals issued an administrative stay at the request of President Trump’s administration against a district judge’s order that returned the National Guard to the authority of the governor of California.

“The court has received the government’s emergency motion for stay pending appeal,” the Ninth Circuit wrote briefly in its ruling.

President Trump mobilized California’s National Guard in response to the ongoing anti-ICE riots and vandalism taking place in Los Angeles. The Justice Department, in its appeal, called the lower court’s ruling “unprecedented” and an “extraordinary intrusion on the President’s constitutional authority as Commander in Chief.”

President Trump commended the appellate decision, stating, “The appeals court ruled last night that I can use the National Guard to keep our cities, in this case Los Angeles, safe. If I didn’t send the military into Los Angeles, that city would be burning to the ground right now. We saved L.A. Thank you for the decision!!!”
