The department says the former EMTALA policy “does not reflect” the agenda of President Trump’s administration.
The Department of Health and Human Services (HHS) rescinded a 2022 policy that requires Medicare healthcare providers to provide abortions. In its announcement, the Centers for Medicare & Medicaid Services (CMS) said that the interpretation did “not reflect the policy of this administration.”
“CMS will continue to enforce [the Emergency Medical Treatment & Labor Act], which protects all individuals who present to a hospital emergency department seeking examination or treatment, including for identified emergency medical conditions that place the health of a pregnant woman or her unborn child in serious jeopardy,” the agency stated. “CMS will work to rectify any perceived legal confusion and instability created by the former administration’s actions.”
