U.S. Judge Timothy Kelly declined to place a temporary restraining order to block the firing of Shira Perlmutter as register of copyrights. He said such a move requires a demonstration of “irreparable harm.” The judge said he was not ruling on the merits of the case, though the court has accelerated the lawsuit on whether President Donald Trump has the authority to remove officials from the Library of Congress and its agencies.
Judge Kelly cited the recent decision of the Supreme Court to allow the firing of officials from national labor boards as cases from Cathy Harris from the Merit Systems Protection Board and Gwynne Wilcox from the National Labor Relations Board play out.
The Supreme Court’s order stated, “The stay reflects our judgment that the Government is likely to show that both the NLRB and MSPB exercise considerable executive power.”
“All organizations are more effective when leaders are rowing in the same direction,” White House spokesperson Anna Kelly stated. “President Trump reserves the right to remove employees within his own Executive Branch who exert his executive authority.”
