Appeals Court Issues Stay on Lower Court Block of Tariffs

The full 11-judge panel made the decision to allow the tariffs to temporarily remain in place.

The Federal Circuit U.S. Court of Appeals issued a stay of the Manhattan-based Court of International Trade’s decision to overturn most of President Donald Trump’s tariffs. The appellate court gave plaintiffs until June 5 to respond to its stay on Thursday.

White House trade adviser Peter Navarro said, “The pause will not affect the negotiations in any way if people out there in the world simply look at the court decision.”

“The court was clear, as I said, that [the] President has broad authority to impose tariffs,” he added, in a nod to a passage from the lower court ruling that noted the president has other avenues apart from emergency powers to impose duties on imports. He said that the administration has heard from countries who have pledged to “continue to negotiate in good faith.”

White House Press Secretary Karoline Leavitt cited how Congress voted down measures to intervene in the president’s tariff plans. If the court’s overturn of the tariffs under emergency authority prevailed, administration officials have indicated other legal means to impose tariffs.
