Brian Edward Murphy was born in 1979 in Columbia, Maryland. He earned an undergraduate degree from the College of the Holy Cross and his Juris Doctor from Columbia University. 

Murphy was a public defender in the Massachusetts Committee for Public Counsel Services. He became an associate, then a partner, in private law firms. He became a supervising attorney for Worcester County Bar Advocates.

Murphy was nominated by President Joe Biden to serve on the United States District Court for the District of Massachusetts. He was confirmed by the Senate and received his commission in December 2024.

Judge Brian Murphy of the Massachusetts U.S. District Court ruled that President Donald Trump’s administration must give criminal illegal aliens the due process of a 15-day window to contest deportation to a third country.

Judge Murphy refused a request from the administration to reconsider his ruling, claiming that the Department of Homeland Security (DHS) violated his preliminary injunction issued in April requiring adequate due process to migrants who are deported to third countries. The deportees to South Sudan had each been convicted of rape, homicide, armed robbery, and several other crimes.

The judge wrote, “Plaintiffs again moved for a temporary restraining order… alleging that Defendants were violating or had already violated the Preliminary Injunction.” 

He added, “It is hard to take seriously the idea that Defendants intended these individuals to have any real opportunity to make a valid claim.”

Judge Murphy stated that the migrants’ having criminal histories “does not change due process.” He indicated willingness for due process to be conducted by the DHS in South Sudan.
