SCOTUS Allows Injunction in Alien Enemies Act Case

The majority ruled that the president’s administration did not provide Venezuelan detainees sufficient time to contest deportation.

The Supreme Court approved an injunction to prevent the removal of Venezuelan nationals under the Alien Enemies Act on Friday. They determined that President Trump’s administration had not provided adequate time or resources to contest their deportation.

“Under these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster,” the ruling read. “But it is not optimal for this Court, far removed from the circumstances on the ground, to determine in the first instance the precise process necessary to satisfy the Constitution in this case. We remand the case to the Fifth Circuit for that purpose.” 

Justices Thomas and Alito dissented from the opinion.
