Mark Allan Barnett was born in 1963 in Reading, Pennsylvania. He earned an undergraduate degree from Dickinson College and a Juris Doctor from the University of Michigan Law School. He served as an associate at a law firm.

Barnett became an attorney in the Department of Commerce’s Office of Chief Counsel for the Import Administration, later serving as Deputy Chief Counsel. He served as trade counsel for the House of Representatives Ways and Means Committee’s Subcommittee on Trade.

Barnett was nominated by President Barack Obama to a seat on the United States Court of International Trade in July 2012. His nomination was returned to the president, who renominated Barnett to the position. He was confirmed by the Senate and received his judicial commission in May 2013. He became chief judge in April 2021.

In the News…

The U.S. Court of International Trade will hear oral arguments this coming week for the legal challenge from the attorneys general of twelve states against President Donald Trump’s tariffs. It is one of several lawsuits that claim President Trump does not have the authority under the International Economic Emergency Powers Act to enact the tariffs.

Last week, a three-judge panel of the International Trade Court rejected a request to place a temporary restraining order against the president’s tariffs in another case as it proceeds. The panel stated that plaintiffs in that case had not proven they suffered “immediate and irreparable harm,” which is required for such an order.

Chief Judge Barnett assigned the states’ lawsuit to this same three-judge panel. The panel invited input from the state attorneys general on the preceding case in which they refused the temporary restraining order.
