Judge Rules Criminal Aliens Cannot Be Deported Under Alien Enemies Act

The decision is the first legal judgment regarding the use of the act.

On Friday, Judge Fernando Rodriguez blocked President Trump’s administration from using the Alien Enemies Act to enact expedited deportations. This is the first court decision to conclude that President Donald Trump’s use of the Alien Enemies Act exceeds his authority, though a number of other court rulings temporarily paused deportations in other parts of the country.

In his opinion, Judge Rodriguez wrote that the president’s administration does “not possess the lawful authority under the AEA, and based on the Proclamation, to detain Venezuelan aliens, transfer them within the United States, or remove them from the country.”

The judge stated that the act only applies to an “armed, organized attack“ against the U.S. and that the entry of illegal alien gang members and terrorists do not qualify.

His decision continued, “Allowing the President to unilaterally define the conditions when he may invoke the AEA, and then summarily declare that those conditions exist, would remove all limitations to the Executive Branch’s authority under the AEA, and would strip the courts of their traditional role of interpreting Congressional statutes to determine whether a government official has exceeded the statute’s scope. The law does not support such a position.”
