Federal Judge Rules Harvard Must Face Antisemitism Lawsuit

He rejected the university’s request to dismiss under the First Amendment.

District Judge Richard Stearns ruled that Harvard University must face a lawsuit alleging the Ivy League school neglected to curb antisemitic behavior. The university attempted to have the lawsuit dismissed, saying that the claims of harassment alleged by Jewish students were actions protected by the First Amendment. In his opinion, Judge Stearns called Harvard’s claims “dubious.”

“To conclude that the [Student Advisory Committee] has not plausibly alleged deliberate indifference would reward Harvard for virtuous public declarations that for the most part, according to the (complaint), proved hollow when it came to taking disciplinary measures against offending students and faculty,” Judge Stearns wrote. “The facts as pled show that Harvard failed its Jewish students.” 

Since Israel invaded Gaza after Hamas attacked Israel on October 7 of last year, instances of antisemitism have increased at many notable universities. Other Ivy League schools have faced similar cases this year.
