Appeals Court Revives Military Leave Case Against American Airlines

Appellate judge indicates military leave is a civic duty.

A panel of the 3rd Circuit Court of Appeals voted to revive a class action lawsuit against American Airlines for its failure to pay pilots during short-term military leave. A group of reservists and National Guard members had filed a class action lawsuit against American Airlines under the Uniformed Services Employment and Reemployment Rights Act of 1994

Judge Arianna Freedman stated that military leaves are a civic duty, similar to jury duty. They are also not optional, as the pilots do not have control over their deployments.

The case will return to the district court in which it was dismissed in 2022.
