Appeals Court Rules COVID-19 Workers Not Entitled to Hazard Pay

Federal workers’ exposure to coronavirus is not covered by current regulations.

The Federal Circuit Court of Appeals ruled against federal workers this week, saying that they are not entitled to extra pay for being regularly exposed to COVID-19 at their place of work.

188 former and current federal prison employees filed against President Biden’s Office of Personnel Management (OPM), saying that they should receive hazard pay for their prolonged exposure to COVID-19 without adequate protective gear or safety precautions.

However, the circuit court majority said that there are no policies in place, legally speaking, that requires the federal government to provide hazard pay, even if they believe they should have.
