HHS Announces Guidance that Covers Emergency Abortions

Life-saving and health-saving abortions are still covered by the department.

The Department of Health and Human Services (HHS) published clarifying guidance on Monday regarding the Emergency Medical Treatment and Active Labor Act. This legislation protects healthcare providers when offering emergency care for dire situations. The federal health department reaffirmed that this law protects emergency abortions when they are necessary to save the life or health of the mother.

“Under the law, no matter where you live, women have the right to emergency care — including abortion care,” said HHS Secretary Xavier Becerra. “Today, in no uncertain terms, we are reinforcing that we expect providers to continue offering these services, and that federal law preempts state abortion bans when needed for emergency care.”
