David N. Hurd was born in May 1937 in Hancock, New York. He earned an undergraduate degree from Cornell University and received a Juris Doctor from Syracuse University College of Law. He was in private practice in Utica, New York.

He worked part-time as an assistant district attorney at the Oneida County District Attorney’s Office. He served eight years as a United States Magistrate Judge of the U.S. District Court for the Northern District of New York.

He was nominated by President Bill Clinton to a seat on the United States District Court for the Northern District of New York. After confirmation by the Senate, he received his commission in September 1999.

In the News…

Before leaving office, New York Governor Andrew Cuomo announced a healthcare worker vaccine mandate prompting more than a dozen healthcare professionals to request a court enjoinder. The governor’s mandate requires hospitals staff and employees of long-term care facilities to be vaccinated in order to remain employed.

A legal argument has taken shape under the umbrella of Title VII of the 1964 Civil Rights Act.

Judge David Hurd of the U.S. District Court for the Northern District of New York granted the temporary restraining order. “The vaccine mandate is suspended, the order reads, and the State Department of Health is “barred from taking any action, disciplinary or otherwise, against the licensure, certification, residency, admitting privileges or other professional status or qualifications of any of the plaintiffs on account of their seeking or having obtained a religious exemption from mandatory COVID-19 vaccination.”

His decision is certain to influence other federal judges facing similar matters across the country.
