DOJ Files Emergency Order Against Texas

Argues that fetal heartbeat law violates the 14th amendment.

On Tuesday, the Department of Justice filed an emergency order at a U.S. District Court requesting a temporary halt to a new Texas law that bans abortions after six weeks of gestation. The Department argues the law, known as S.B. 8, violates women’s 14th amendment rights, as well as the federal government’s supremacy over state laws. 

The text of the emergency order said, “this relief is necessary to protect the constitutional rights of women in Texas and the sovereign interest of the United States in ensuring that its States respect the terms of the national compact. It is also necessary to protect federal agencies, employees, and contractors whose lawful actions S.B. 8 purports to prohibit.”
