Philadelphia Court Refuses to Block Mail-in Ballots

Legal challenge to post election day ballots denied..

One of several lawsuits filed in the wake of the U.S. election, President Trump’s campaign made the legal claim that mail-in ballots received after election day in Pennsylvania should not be counted in the final tally. On Friday, Chief U.S. Circuit Judge D. Brooks Smith ruled against the motion, allowing 8,300 mail-in ballots to be included in the total.

The ruling was handed down by a three-judge panel. Their reason for denying the request for an injunction was the chaotic nature of the pandemic affecting voters just trying to fulfill their civic duty. “The COVID-19 pandemic… has caused immense loss and vast disruption,” Judge Smith wrote. The court stated that its ruling did not address the state’s decision to extend the acceptance of ballots, nor the state court’s authority to allow it.
