Final Cases of the Week Heard at Supreme Court
Cases deal with the clean water act and Retirement Security
On Wednesday, the Supreme Court heard oral arguments in the cases of the County of Maui, HI v. Hawaii Wildlife Fund and Retirement Plans Comm. of IBM v. Jander.
In the case of the County of Maui, HI v. Hawaii Wildlife Fund seeks to answer if the Clean Water Act’s standards for pollution cover polluted groundwater before reaching a federal waterway. The act requires a permit for the addition of a pollutant that comes from “any point source.” The Court will determine if groundwater is a point source.
Retirement Plans Comm. of IBM v. Jander deals with the particulars of the Employee Retirement Income Security Act of 1974 (ERISA). The act requires those managing pension plans to apply the duty of prudence (administering a trust with a degree of skill, care, and caution). This case seeks to determine if the standard set in a previous Supreme Court decision causes individuals at IBM to be liable for mismanagement.
